“The Centers for Social Welfare, although informed that a nine-year-old boy lives with his parent-criminal, in their inability to determine who is competent to act in this case, left the child unprotected for a whole year”, reported from First Children's Embassy in the World “Megjashi”.
The First Children's Embassy in the World “Megjasi” informs about a case of a nine-year-old child from Gevgelija whose rights were violated because the Centers for Social Welfare did not react adequately. The case was reported at the embassy on the SOS phone line. The parents of child have been divorced for a long time, and parent who does not have custody over his son showed no desire to get in touch with him.
“The parent last year for the first time expressed a desire to see the child, with a mutual agreement of his parents that the child should spend a week with the other parent. After that time the parent who is not a guardian, decided that the child should stay with him in future. Unable to look after his child, because of his antisocial and promiscuous behavior, and because of his long-time drug addiction, he did not take care of the child for a whole year. The child was locked at home and starving”, say from Embassy “Megjasi”.
The child did not attend the school for a whole year and lived in constant fear. The parent and the relatives who had the right of taking care, protecting and upbringing the child went to the Centers for Social Welfare and the SI-Gevgelija to take the child to protect him. But their requests and responses were not taken seriously.
“The school where the child had been enrolled made efforts to inform the relevant Centers for Social Welfare and attempted to visit this home as to determine the reasons for not attending the school, but without any results. The parent was either not at home or refused to open the door. The Centers for Social Welfare, although informed that this child lives with a torturer, in their inability to determine which one of them is competent to act in this case, left this child unprotected for a whole year”, say from the embassy.
The Center for Social Welfare from Gevgelija only recently informed the embassy that the child was taken from the abusive parent and given to his guardians.
“The last case again points out the lack of performance, the rigidity and the irresponsibility of centers in the best interest of the child. Namely, I would like to discuss whether the promptness and efficiency in resolving such cases should depend on the engagement of civil organizations whose main responsibility is to protect the rights of the children. Is it perhaps that if it had not been for our efforts and commitments to act appropriately in this case, the fate of this child would have depended on the administrative procedures that could have lasted well over a year?”, ask from Megjasi.
From the Embassy consider that the inefficiency of the state institutions, their inability to establish the jurisdiction of the centers endangered the normal growth and development of this child and the basic children’s rights to education, health care, optimal growth and development were violated.
Children's Embassy ““Megjasi” noted the inability of the Centers for Social Welfare to resolve a positive or negative jurisdiction, which causes inefficiency in their functioning, immobility and longevity in solving cases where an immediate action is necessary in order to protect the child and his best interests”, say from the embassy, and ask the institutions to be faster in identifying the competencies, and the Ministry of Labor and Social Affairs to increase the inspections in the centers and to punish those responsible for inefficiency. Деветгодишник една година оставен кај родителот насилник
Центрите за социјална работа, иако имале информација дека деветгодишник живее со родител-насилник, во неможноста да утврдат кој од нив е надлежен да постапува во овој случај, цела година го оставиле детето незаштитено, велат од Амбасадата „Меѓаши“
Првата детска амбасада во светот „Меѓаши“ информира за случај во кој на деветгодишно дете од Гевгелија му биле нарушени правата поради нефункционалност во работата на Центрите за социјална работа. Случајот во амбасадата бил пријавен на СОС-телефонот. Родителите на детето веќе подолго време се разведени, а родителот кој нема старателство не пројавил никаква желба да стапи во контакт со него.
- Родителот дури лани првпат изразил желба да го види детето, при што со меѓусебен договор на родителите детето една недела требало да биде со другиот родител. По изминување на договореното време за видување, родителот кој не е старател решил дека детето ќе остане со него. Иако не е во состојба да се грижи, бидејќи има историја на асоцијално, промискуитетно однесување и е долгогодишен корисник на опојни средства, тој цела година не водел грижа за детето, кое било затворено само дома и гладно - велат од „Меѓаши“.
Тоа цела година не посетувало училиште и постојано живеело во страв. Родителот и роднините кои го имале правото на грижа, заштита и воспитание на детето се упатиле до центрите за социјална работа и до СВР Гевгелија со цел да го земат детето и да го заштитат. Но нивните барања и реакции не биле сериозно земени предвид.
- Училиштето во кое детето било запишано правело напори и ги информирало соодветните центри за социјална работа и имале обид за домашна посета за да се увидат причините за непосетувањето на училиште, но немало никаков резултат. Родителот или не бил дома или не ја отворал вратата. Центрите за социјална работа, иако имале информација дека тоа дете живее со насилник, во неможноста да утврдат кој од нив е надлежен да постапува во овој случај, цела година го оставиле детето незаштитено - велат од амбасадата.
Центарот за социјални работи од Гевгелија дури деновиве ја информирал амбасадата дека детето е земено од насилниот родител и предадено на старателите.
- Последниов случај повторно ја посочува недоволната ефикасност, ригидноста и неодговорноста на центрите во постапување во најдобар интерес на детето. Имено, би сакале да го наметнеме прашањето дали брзината и ефикасноста во решавањето на ваквите случаи треба да зависи од ангажманот на граѓанските организации што се грижат за заштита на правата на детето. Дали можеби да не беа нашите напори и заложби за соодветно постапување во овој случај, судбината на ова дете ќе зависеше од административните процедури, кои можеби ќе траеја и повеќе од една година? - прашуваат од „Меѓаши“.
Од амбасадата сметаат дека неефикасноста на државните институции, неможноста за утврдување на надлежност на центрите го довеле во прашање оптималниот раст и развој на детето, а прекршени се основните детски права на образование, здравствена заштита, оптимален раст и развој.
- „Меѓаши“ констатира неможност на центрите за социјална работа во разрешувањето на позитивна или негативна надлежност, што предизвикува неефикасност во нивното работење, немобилност, како и долготрајност во решавање на случаи за кои треба веднаш да се реагира со цел да се заштити детето и неговите најдобри интереси - велат од амбасадата, која препорачува институциите да бидат побрзи во утврдувањето на надлежностите, како и Министерството за труд и социјални работи да ги засили инспекциите во центрите и да ги казни одговорните за неефикасноста.
