Reaction on the last case of incest that the father from Veles committed over his three daughters

            The First Children’s Embassy in the World Megjashi on the last case of incest that the father from Veles committed over his three daughters contacted the Center for social work (CSW) – Veles and the Secretariat of internal affairs (SIA) – Veles.

The director of CSW - Veles informed us that they have no records of this family, and for more detailed information she asked us to address them in written form. By SIA - Veles we received information that they have detained the suspect and he has been questioned in cooperation with CSW, the suspect’s wife and the girls were questioned as well inside the premises of CSW. Gynaecological findings show that the girls have sings of defloration that date from before. The suspect has been held by the police and he will be brought in front of investigative judge and it is going to be asked for the suspect to be detained in jail as measure. At the same time criminal charge is going to be filed for committing incest and family violence.

The children are not supposed to be returned to their family because in such cases under the pressure of their closest relatives and facing insufficient understanding about the condition they were in, very often children change their statements. That is the reason why we are asking the children to be taken care of in a foster family.

 The First Children’s Embassy in the World Megjashi is asking once again for the most severe punishment for the father rapist, and at the same time is asking the authorities not to exclude the possibility that the mother is an accomplice in this criminal act. If the mother knew and approved the sexual abuse of the three girls we are asking for deprivation of the parental right of both parents and also punishment for the mother if she did not report the case.

In such situations it is necessary the children to be placed in specialized shelter for children victims of sexual abuse that is going to be operating 24 hours. The children victims should get basic conditions to get well, rehabilitate, re-socialize and reintegrate in the community. The stay in this shelter should be of a temporary character, which means that forms of special families that are going to take care of these children should be developed.

At the same time we would like to ask the journalists to pay particular attention of the protection of personal data of the children which is of a great importance for the respect of the integrity and identity of the child victim. 

Major role in protection and prevention of the children from sexual abuse and pedophilia have the citizens and the closest relatives. If they do react on time and report the violence they can help the perpetrator to be imprisoned on time, as well as to prevent the violence of the children by a member of their family also on time.

            We want to remind that the findings of the Center for social work that over some person has been committed family crime are obtained by citizens, officials and entities, which are responsible without any delay to inform the Center for their findings. In the Family law stands that a fine ranging from 500 to 1000 Euro against value of the Dinar is going to be sentenced for violation made by individual who is not going to act in accordance to the stated obligations in the article 94-g, paragraph 3 of this law.

            Fine ranging from 3000 to 5000 Euro against value of the Dinar is going to be sentenced for violation made by an entity that is not going to act in accordance to the stated obligations in the article 94-g, paragraph 3 of this law.

            The centers for social work should work on field and should have insight into all the dysfunctional families, families with risk, families with difficult social structure as prevention from violence and children’s abuse. Social workers should take away the parental right of the parents that are rapists, as well as parents that are abusing their children on time. The country institutions take the responsibility for the children's safety and health every time they are not able to receive that treatment by their parents. The country should be mobilized and receive the message that not all parents are automatically responsible parents.

            The First Children’s Embassy in the World Megjashi reminds that the number of times the children victims of sexual abuse give their statements should be taken in consideration as well. It must not be allowed the child to give statements neither in the police, in the centers for social work, nor in the courts. It should be only one statement, because retrospection of the act of violence is an additional harassment for the child.   

            We appeal the country institutions to be careful with the children victims of sexual abuse. If the entering of the investigation by the authorities is inappropriate and unprofessionally performed or if for example such child faces the rapist again – that is going to be repetition of the violence, only in this case except the survived experience of sexual abuse the child will also suffer psychological violence from the institution itself, or respectively by some experts involved in the investigation.

            Until now the First Children’s Embassy in the World Megjashi has reacted many times, demanded responsibility in the cases of sexual abuses over children and pedophilia as well as requested the penalties for the child rapists to be increased. However, despite the more frequent detection and detention of pedophiles by the police and despite the changes in the criminal law that allows far severe penalties it is obvious that not even repressive measures lead to reduction of the cases of sexual abuse of children.

             The last heinous case of continuous rape committed by the father from Veles over his three daughters shows that there is a lack of functional protection of the children.

            In addition we enclose the Draft – code that was prepared by the journalists from the Trainings for journalists for the rights of the child with an emphasis on the protection of the children from sexual abuse and pedophilia on how the journalists should report cases where children are victims of sexual abuse and pedophilia.
